The Challenge
Company developed a revolutionary, 100% biodegradable packaging material alternative to single-use plastics. As they prepared for a highly publicized launch across Southeast Asia, they faced a critical risk: their proprietary manufacturing process was highly vulnerable to reverse-engineering by larger, established competitors. Furthermore, they needed to ensure their brand name was cleared for use in multiple neighboring countries to avoid trademark infringement lawsuits.
Our Strategy & Solution
Our IP consultancy team partnered with Company lead engineers and executives to develop a robust, multi-layered protection strategy:
- Patent Protection: We conducted a comprehensive Prior Art Search to confirm the novelty of their material. Our patent attorneys then drafted and filed a robust utility patent application, meticulously defining the chemical claims to prevent competitors from utilizing workarounds.
- Trademark Expansion: We conducted clearance searches across Malaysia, Singapore, and Indonesia. Utilizing the Madrid Protocol, we streamlined their trademark application to secure the “Company” brand identity across all target markets simultaneously.
- Copyright: We registered the copyright for their unique software source code used in their automated manufacturing machines.
